Section 5 – Risk of Loss

Title and risk of loss for all products pass to you upon delivery to the carrier. We are not responsible for lost, stolen, or damaged shipments once possession has passed to the carrier.

Section 6 – Returns and Refunds

All sales of consumable hemp products are final, except where otherwise required by law. If you receive a damaged or incorrect product, you must contact us within 48 hours of delivery with photographic evidence for evaluation.

Section 7 – Intellectual Property

Binding Arbitration. You and Good Leaves Dispensary agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site and products will be settled by binding arbitration administered under the Commercial Arbitration Rules of the American Arbitration Association.

The arbitrator shall apply the substantive laws of Texas without regard to conflict of law rules.

Waiver of Class Actions. You agree to arbitrate disputes on an individual basis and waive any right to participate in a class action or representative proceeding.

These arbitration obligations survive termination of your relationship with the Site.

Section 9 – Limitation of Liability

To the fullest extent permitted by law, Good Leaves Dispensary and its affiliates shall not be liable for:

a. Any indirect, incidental, special, punitive, or consequential damages.

b. Any damages exceeding the amount you paid for the product giving rise to the claim.

This limitation applies even if we have been advised of the possibility of such damages.

c. Your violation of any law or rights of a third party.
